By accessing and using Isolvio, you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.
You are granted access to use Isolvio solely for the purpose of backing up and managing your databases as permitted by these Terms. You agree not to:
When you create an account with Isolvio, you are responsible for:
Free First Backup: Each account receives one free monthly backup. This quota resets on the first day of each month.
Pay-Per-Use Model: Additional backups beyond your free monthly backup are charged on a per-backup basis according to the pricing tier you select (Monthly €0, Weekly €0.50, Daily €1.00, Hourly €2.50 per backup).
Account Top-Up: You add funds to your account through Stripe payment processing. Your account balance is then used to cover the cost of backups beyond your free allocation.
Automatic Charging: When you create or enable a backup job, the service will automatically deduct the appropriate amount from your account balance for each backup run. The cost is calculated at the time the backup is created.
All payments for account top-ups are processed securely through Stripe. We follow applicable payment and consumer protection regulations in your jurisdiction.
Top-Up Funds: Account top-ups are generally non-refundable once processed and added to your account. Funds added to your account are credits applied to the cost of your backups and cannot be refunded, transferred, or exchanged for cash.
Individual Review: If you have a legitimate concern about a transaction or believe a refund is warranted, please contact us at support@isolvio.com with details of your situation. We will review your case individually and respond within 10 business days.
You are responsible for reviewing your account balance and billing history before completing any top-up transaction. We recommend only adding funds you intend to use within a reasonable timeframe.
If your account balance becomes negative (due to backup costs exceeding your available balance), the following will occur:
We recommend enabling automatic top-ups or monitoring your account balance regularly to avoid service interruptions.
Each backup is limited to a maximum of 2GB in database size. Attempts to back up databases larger than 2GB will fail. It is your responsibility to ensure your databases comply with this size restriction.
We Do Not Store Your Backups: Isolvio creates backups of your database and transfers them to your designated storage location (S3-compatible or other type of cloud storage that you control) within 24 hours of creation. We do not retain copies of your backups on our infrastructure, and all data is deleted after successful transfer to your storage.
Your Storage Responsibility: You are responsible for:
If your storage becomes unavailable or credentials are invalid, backup jobs will fail, and we will send you notifications.
Service Operation: We strive to maintain reliable and consistent operation of the Isolvio backup Service. However, we do not guarantee:
Storage Dependency: Since your backups are stored exclusively on your chosen storage provider, backup success and availability depend partly on the reliability and availability of that provider. We are not responsible for issues with your storage provider's infrastructure or service. We recommend choosing a reliable storage provider and maintaining regular monitoring of your storage account to ensure adequate capacity and accessibility.
Our Responsibility: We are responsible for creating and transferring your backups to your storage location within 24 hours. We are not liable for failed backups, data loss, or service interruptions caused by factors beyond our reasonable control, including but not limited to: network issues, storage provider outages, database unavailability, or other force majeure events.
Limitation of Damages: Except in cases of gross negligence or willful misconduct, neither Isolvio nor its directors, employees, or agents shall be liable for indirect, incidental, special, consequential, punitive, or exemplary damages, including but not limited to damages for lost profits, lost revenue, lost business opportunity, loss of data, or business interruption, even if we have been advised of the possibility of such damages.
Cap on Liability: Except for liability that cannot be excluded by law (such as gross negligence or breaches of fundamental obligations), Isolvio's total aggregate liability to you shall not exceed the total fees paid by you in the 12 months preceding the event giving rise to the claim.
Responsibility for Data Loss: You are solely responsible for maintaining backups of your data. While we provide a backup service, you should maintain independent backups and recovery procedures. Isolvio is not responsible for loss or corruption of data resulting from backup failures, storage unavailability, or circumstances beyond our reasonable control.
No Waiver: Nothing in these Terms excludes or limits liability for death, personal injury, fraud, gross negligence, or any matter that cannot be excluded or limited by applicable law (including GDPR and Dutch law).
Termination by Us: We may suspend or terminate your account and access to the Service if you violate these Terms of Service, engage in fraudulent activity, or abuse our Service. Where reasonably practical, we will provide you with prior notice and an opportunity to remedy any violation.
Immediate Termination: We may terminate your account immediately without prior notice if:
Termination by You: You may terminate your account at any time by contacting us at support@isolvio.com. Upon termination, all your backup jobs will be disabled and you will no longer be charged for additional backups.
Data After Termination: Upon account termination, we will delete your account data from our systems within 30 days. Backups stored in your own cloud storage remain your responsibility to manage and delete.
We reserve the right to modify these Terms of Service. How changes take effect depends on their nature:
Governing Law: These Terms of Service are governed by and construed in accordance with the laws of the Netherlands. Any disputes arising from these Terms shall be resolved under Dutch law.
Jurisdiction: You agree that any legal action or proceeding related to these Terms or your use of the Service shall be brought exclusively in the courts of the Netherlands.
Informal Resolution: Before initiating legal action, we encourage you to contact us at support@isolvio.com to attempt to resolve any disputes informally. Most disputes can be resolved through direct communication within 30 days.
